Waiting for a visa decision: understanding interim status
Applying for another visa does not, by itself, tell you what status or conditions will apply while you wait. This guide explains interim visas and the important differences to check before your current visa expires.
Where to start
Interim status is not a universal promise. Check the timing, location, application type, issued notice and actual conditions before assuming work, study or travel rights continue.
Key points
Check current visa expiry
The expiry date decides how urgent the question is and whether the current visa period is still active.
Check application timing
Applying before or after expiry can lead to very different status questions, so the submission date matters.
Understand interim status
An interim visa is about lawful stay while an application is decided, but its conditions depend on the old visa and the new application.
Do not assume work or study rights
Being allowed to stay does not automatically mean the same work, study or travel rights continue. The actual interim conditions need to be read.
Apply before the current visa expires
INZ public guidance says you need to apply for a new visa before your current visa expires if you need to stay longer. Once the current visa has already expired, the situation is different and can become urgent.
Interim visa conditions are not one-size-fits-all
INZ says Interim Visa conditions depend on the type of visa previously held and the type of visa being applied for next. That means work, study and travel rights should be checked against the actual interim visa conditions.
Residence applications can be different
Some residence pathways have special interim visa settings. INZ says a Skilled Migrant Category Interim Visa is normally valid for 24 months. If the residence application is withdrawn or declined, the interim visa expires 2 months after that event. It also restricts other temporary-visa applications, family sponsorship and most condition changes, so it should not be treated like an ordinary temporary visa.
An expired visa is a different problem
If a visa has already expired, INZ says the stay in New Zealand becomes unlawful. That is different from waiting on an interim visa, and the official guidance should be checked immediately.
What to check next
- Do not assume an interim visa allows work, study or travel just because it allows a person to stay lawfully.
- Check the exact visa expiry date, application submission date and interim visa conditions.
- If a visa has expired or expiry is very close, treat the question as urgent and use official guidance or qualified help.
